Florida Treatment Center – Notice of Privacy Practices

This notice describes how medical information about you may be used and disclosed and how you can access this information. Please review it carefully.

Our Responsibilities

Florida Treatment Center is required by law to:

  • Maintain the privacy and security of your protected health information (PHI)
  • Provide you with this Notice of Privacy Practices
  • Follow the terms of this notice
  • Notify you promptly if a breach compromises the privacy or security of your PHI

Your Rights

You have the right to:

  • Access Your Medical Record: Request a copy of your health and contact information.
  • Correct Your Record: Request changes if you believe your information is incorrect or incomplete.
  • Request Confidential Communications: Ask us to contact you in a specific way (e.g., home phone or mail).
  • Limit What We Use or Share: Request restrictions on how we use or disclose your information. While we are not always required to agree, we will comply with any request where disclosure is to a health plan and you have paid in full out-of-pocket.
  • Get a List of Disclosures: Request a record of disclosures we’ve made of your information for up to six years.
  • Get a Copy of This Notice: Request a paper copy of this notice at any time, even if you’ve agreed to receive it electronically.
  • Choose Someone to Act for You: If someone is your legal guardian or has medical power of attorney, they can exercise your rights.
  • File a Complaint: If you believe your rights have been violated, you may file a complaint with us or with the U.S. Department of Health and Human Services. We will not retaliate against you for filing a complaint.

Our Uses and Disclosures

We may use and share your PHI to:

Treat You

We can use your health information and share it with other professionals involved in your care.

Example: A doctor treating you for an injury asks another provider about your overall health condition.

Run Our Organization

We use your health information to run our facility, improve your care, and contact you when necessary.

Example: We use health information to manage treatment and services.

Bill for Services

We use and disclose your health information to bill and receive payment from health plans or other entities.

Example: We give your health plan information about a service you received so it can pay us or reimburse you.

Other Ways We May Use or Share Your Information

We are allowed or required to share your information in other ways – usually in ways that contribute to the public good, such as public health and research. We must meet certain legal conditions before we can share your information for these purposes.

These include:

  • Public health and safety issues (e.g., disease prevention, product recalls, reporting abuse or neglect)
  • Health research (with appropriate safeguards)
  • Responding to legal requests (e.g., court orders, subpoenas)
  • Law enforcement, medical examiners, and funeral directors
  • Workers’ compensation claims
  • Compliance with government health oversight agencies

Your Choices

In these cases, you have the right to decide if we share your information:

  • Marketing and Promotional Communications: We will not use or share your information for marketing without your explicit written authorization.
  • Fundraising: We may contact you for fundraising efforts, but you can opt out of further contacts.
  • Sharing with Family and Friends: You can tell us if we may share your information with family, close friends, or others involved in your care.

We Will Never Share Your Information Unless You Give Us Written Permission For:

  • Sale of your PHI
  • Most uses and disclosures of psychotherapy notes
  • Marketing purposes (unless permitted under HIPAA exceptions)

Changes to This Notice

We reserve the right to change the terms of this notice. The new notice will apply to all PHI we maintain. We will provide an updated notice upon request, in our office, or on our website.
